Anota Terms of Service

These Terms of Service (the Terms) govern your use of the Anota iPhone and Apple Watch app (the App). By downloading or using Anota, you agree to these Terms. If you do not agree, do not use the App.
1) Who we are
Anota is operated by Rui Peres (“we”, “us”).

2) What Anota provides
Anota is an offline-first padel scoring and insights tool. It lets you record sessions on Apple Watch, optionally record your in-the-moment judgement about why points ended, save an Apple Health workout when authorized, and review session history and descriptive statistics on iPhone.
Anota’s classifications are user-entered and subjective. Statistics describe the information recorded in the App; they do not objectively reconstruct a rally, establish causation, or guarantee an improvement in performance.
3) Eligibility and safe use
You must be legally permitted to use the App in your country and comply with the applicable App Store rules. Minors may use Anota only with permission from a parent or guardian where required by law.
Padel and exercise involve physical risk. Anota is not a medical device, health service, emergency service, official match authority, or substitute for medical, coaching, legal, or other professional advice. Stop exercising and seek appropriate professional help if you have health or safety concerns.
4) App licence and Apple terms
Anota is licensed, not sold. Your use is also subject to Apple’s App Store Usage Rules and the Apple Standard End User Licence Agreement, unless Apple presents other applicable terms.
We grant you a personal, limited, non-exclusive, non-transferable licence to use Anota on Apple devices you own or control, as permitted by Apple’s rules and these Terms.
5) Free session access and Anota Pro
The first 20 manually ended sessions are fully viewable and filterable without Anota Pro.
- Every manually ended session counts, including a zero-point session or a session ended before a set is complete.
- An active session does not count until you manually end it.
- After the first 20 sessions, Anota continues to record later sessions in full. Limited summary information remains visible, while detailed history, filtering, and analysis are locked.
- Purchasing Anota Pro unlocks all previously recorded locked sessions and statistics retroactively.
- Entitlement checks restrict viewing and analysis only. They do not intentionally prevent session recording, workout completion, local persistence, or recovery.
This free-session allowance is not a free trial and does not convert automatically into a paid purchase.
6) Subscriptions and lifetime purchase
Anota Pro may be purchased through Apple as:
- a monthly auto-renewing subscription;
- a yearly auto-renewing subscription; or
- a one-time, non-consumable lifetime purchase.
The price, currency, billing period, taxes, and other purchase details shown in the App Store purchase sheet at the time of purchase control over any examples shown elsewhere.
Auto-renewing subscriptions
Monthly and yearly subscriptions renew automatically unless you cancel through your Apple Account before renewal. Apple charges your Apple Account and manages billing, renewal, cancellation, grace periods, and billing recovery under the applicable App Store rules.
You can manage or cancel a subscription in your Apple Account subscription settings. Deleting Anota does not cancel a subscription.
Lifetime purchase
“Lifetime” means a one-time, non-expiring Anota Pro entitlement for this App rather than a recurring subscription, unless Apple refunds, revokes, or reverses the transaction. It does not mean the purchaser’s lifetime and cannot guarantee that the App, Apple platforms, third-party services, or every current feature will remain available indefinitely. Any mandatory rights under applicable consumer law remain unaffected.
Restore and refunds
Use Restore Purchases in the App to ask Apple and RevenueCat to restore an eligible purchase associated with your Apple Account. Restoration can depend on Apple, network, storefront, and account availability.
Apple processes payments and handles refund requests under its policies. We cannot issue App Store refunds or access your payment-card information.
7) iCloud, HealthKit, and third-party services
Anota does not require a separate Anota account. When available, it uses Apple’s private CloudKit service to synchronize selected session, participant, and roster data across devices signed into the same iCloud account.
CloudKit is an eventual synchronization service, not a guaranteed archive or immediate live connection. Signing out, changing iCloud accounts, losing connectivity, exhausting storage, or service failures can delay or prevent synchronization. Existing local Anota data may synchronize to the iCloud account currently active on the device.
HealthKit access is optional. If you grant permission, Anota may read authorized workout and fitness information and save a workout to Apple Health. You can manage Health permissions in Apple system settings. Core scoring remains available if Health permission is denied, although workout features may be unavailable.
Apple and RevenueCat operate under their own terms and policies. We are not responsible for third-party outages, account restrictions, or changes outside our control.
8) Your information and device responsibility
You are responsible for the information you enter and for maintaining access to your devices and Apple Account. Only enter another person’s name or information when you have an appropriate reason and permission to do so.
Do not treat Anota or CloudKit as the only backup of important information. Removing the App affects local data, but does not necessarily delete CloudKit records or Apple Health workouts. See the Anota Privacy Policy for more detail.
9) Acceptable use
You agree not to:
- use Anota unlawfully or in a way that infringes another person’s rights;
- interfere with the App, its security, or its normal operation;
- attempt to bypass purchase, access, or entitlement checks;
- reverse engineer, redistribute, or modify the App except where applicable law expressly permits it; or
- use automated or abusive traffic against Apple, RevenueCat, or any service used by Anota.
10) Intellectual property
Anota, its software, design, text, branding, and original content are owned by us or our licensors. These Terms do not transfer ownership to you. Apple and third-party names and services belong to their respective owners.
11) Updates and availability
We may update Anota to fix problems, maintain compatibility, improve security, or change features. We may also change future pricing or availability, subject to Apple’s rules and applicable law.
We do not promise that Anota will be uninterrupted, error-free, compatible with every future device or operating-system version, or available forever. Offline-first recording reduces network dependency but cannot eliminate hardware, software, storage, synchronization, or data-loss risks.
12) Disclaimer and liability
Anota is provided “as is” and “as available” to the maximum extent permitted by law. We do not guarantee the accuracy or completeness of user-entered scores, classifications, workout measurements, statistics, or synchronized copies.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from use of, or inability to use, Anota or a third-party service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Nothing in these Terms affects mandatory consumer rights.
13) Ending use
You may stop using Anota at any time. Deleting the App does not cancel an active subscription; manage subscriptions separately through Apple.
We may suspend access to future versions or services if you materially breach these Terms or if required for security or legal reasons. This does not override rights that Apple or consumer law gives you for an existing purchase.
14) Changes to these Terms
We may update these Terms when Anota, its commercial model, service providers, or legal requirements change. The date at the top shows the latest revision. Material changes apply as permitted by law.
15) Governing law
These Terms are governed by the laws of England and Wales, without depriving you of mandatory consumer protections that apply where you live. If you are a consumer, you may bring proceedings in any court available to you under applicable law.
